Approval Process for Prefabricated Concrete Houses
The approval process for prefabricated concrete houses depends on the nature of the construction land and whether it involves the conversion of agricultural land. Details are as follows:

If agricultural land conversion is involved, approval procedures for agricultural land conversion must be completed. According to Article 44 of the Land Administration Law of the People's Republic of China, when construction occupies land that involves the conversion of agricultural land into construction land, approval authority shall be determined based on factors such as the scale of construction land for cities, villages, and towns as defined in the overall land use plan, and whether it involves permanent basic farmland. The approval process typically includes: the construction unit or individual submitting an application to the local land management department and preparing materials such as the overall land use plan map and agricultural land conversion plan; relevant departments reviewing the materials and approving or forwarding them to higher authorities for approval if they meet the requirements. Unauthorized occupation of agricultural land for construction without approval is illegal.
If agricultural land conversion is not involved, different scenarios need to be handled separately:
- Construction on homestead land: If construction is carried out on rural homestead land, it must comply with the overall land use plan and village plan of the township (town) and must not occupy permanent basic farmland. According to Article 62 of the Land Administration Law, rural villagers building residential houses should give priority to using their original homesteads or vacant land within the village. Taking Bazhong, Sichuan as an example, farmers need to submit a written application to the village group, which will then be discussed and publicized within the group, reviewed by the village level, and jointly reviewed and handled by the township level. After that, the township government will issue the Rural Homestead Approval Certificate and the Rural Construction Planning Permit. Some areas require on-site inspection and approval by the township planning office before construction can commence, and a house construction application form needs to be obtained; after completion, an application for inspection is required, and the township government will organize a verification and issue the Tongjiang County Rural House Construction (Planning Permit and Completion) and Homestead Use Inspection Form. Only after passing the inspection can the house be put into use.
- Construction on other construction land: If construction is carried out on other land that has already been approved as construction land and does not involve agricultural land conversion, it is generally not necessary to go through the agricultural land conversion approval process again, but it must comply with local land use plans and construction management requirements. For example, when building prefabricated concrete houses on industrial or commercial land, it is necessary to apply for a construction project planning permit from the planning department and meet special requirements such as fire protection and environmental protection.
Key reminder: Regardless of the situation, it is essential to confirm the land nature and planning requirements before building a house to avoid demolition or fines due to unauthorized construction. Specific procedures and material requirements may vary depending on regional policies, so it is advisable to consult the local natural resources department or township government in advance.
