Application for Renting Container Houses

Admin September 16, 2026

When renting container houses, it is crucial to pay attention to planning approval and contract validity issues, as unapproved rental contracts may be invalid.

I. Planning Approval Requirements for Container Houses

According to Article 44 of the Urban and Rural Planning Law of the People's Republic of China, temporary construction (including container houses) within urban and town planning areas requires approval from the urban and rural planning authorities. Unauthorized use without approval not only violates the overall urban and rural planning but also poses safety risks. For example, in a case adjudicated by the Beijing Second Intermediate People's Court, Company A rented out modified containers without approval to Company B, and the court ruled the rental contract invalid.

II. Determination of Rental Contract Validity

  1. Invalid Scenarios: If the container house is an unapproved temporary structure, according to Article 3 of the Interpretation of the Supreme People's Court on Several Issues Concerning the Trial of Disputes over Town House Rental Contracts (Amended in 2020), the rental contract is invalid. In this case, the lessee is required to pay occupancy fees for the actual period of use, but the lessor has no right to claim late payment penalties.
  2. Valid Exceptions: If the lessor obtains planning approval before the conclusion of the first-instance court debate, the court may recognize the contract as valid.

III. Considerations for Renting Container Houses

  1. Verify Approval Documents: Before signing the contract, request the lessor to provide temporary construction approval documents from the urban and rural planning authorities to ensure the legality of the house.
  2. Clarify Contract Terms: Include provisions in the contract regarding the allocation of responsibility in case the contract is invalidated due to approval issues, such as requiring the lessor to bear losses during eviction.
  3. Focus on Fire Safety: Some regions require container houses to meet fire safety standards. Verify whether they have passed inspections to avoid being ordered to cease use due to safety hazards.
  4. Choose Compliant Suppliers: Prioritize companies with complete qualifications and good reputations, such as Hangzhou Zhonghao Integrated Housing Co., Ltd. and Beijing Falilai Integrated Housing Technology Co., Ltd. Their products typically comply with national standards and offer one-stop services for transportation and installation.
