Disposal of 36-Square-Meter Container Houses

Admin September 16, 2026

The disposal of 36-square-meter container houses depends on their legality and specific circumstances, primarily divided into legal and illegal scenarios, with special considerations for situations involving leasing.

I. Disposal of Legal Container Houses If a container house has obtained legal land use and planning approvals in accordance with relevant regulations, such as being used as a temporary structure for storage, office, or other specific purposes and approved by relevant authorities, it is considered a legal structure. Its disposal should adhere to the following principles:

  1. Retention for Use: If the house is structurally safe, meets planning requirements, and does not affect the surrounding environment, it can continue to be used without the need for demolition or relocation.
  2. Compensation for Demolition or Relocation: If demolition or relocation is required due to urban planning adjustments or changes in land use, relevant authorities should provide reasonable compensation in accordance with the law, including the replacement cost of the house, relocation expenses, and assistance in arranging new sites for use.

II. Disposal of Illegal Container Houses If necessary approvals have not been obtained, the container house may be considered an illegal structure. According to the Urban and Rural Planning Law of the People's Republic of China, those who fail to obtain a construction project planning permit or build in violation of regulations shall be ordered by the urban and rural planning authorities of the local people's governments at or above the county level to cease construction and take the following measures:

  1. Limited-Time Demolition: Relevant authorities will issue a notice for limited-time demolition, requiring the owner to demolish the structure within a specified period.
  2. Forced Demolition and Fines: If the structure is not demolished within the specified period, it may be forcibly demolished in accordance with the law, and fines may be imposed. The process must ensure legal procedures, such as advance notice and safeguarding the right to statement and defense of the parties involved, to avoid infringing upon legitimate rights and interests.

III. Disposal of Situations Involving Leasing Take the 36-square-meter container house opposite Futian Yujing Shanzhuang as an example. It was once announced for leasing with a five-year term, and the rent was to increase by 3% every two years. However, due to no bidders, it was declared a failed bid on August 6, 2026. In such cases, the following should be noted:

  1. Validity of Lease Contracts: If the house is legal, the lease contract is valid, and both parties must fulfill their obligations as agreed. If the house is illegal, the contract may be deemed invalid due to the illegality of the subject matter.
  2. Post-Failed Bid Disposal: After a failed bid, the lessor may readjust the rent, lease term, and other conditions before announcing again or dispose of the house through other means.
